Web Design Terms of Service - Last Updated 13th June 2006
Delivery
We aim to deliver all web sites within the specified time. However, in some cases where the web site is using scripting technologies such as PHP/MySQL, our time estimates may not be exact. Therefore we do not guarantee a deadline for web sites that use these scripting technologies.
Payment Policy
All payments must be made within 7 days of the date of the invoice using the methods detailed in the email and invoice sent.
Cancellation Policy
Either party may terminate the web design contract between us without reason or penalty with 7 days from the date of the order. Hosting costs may not however be refunded and any free domain name that was registered during the 7 days must be paid for by the customer.
Updates
We allow any corrections to the text on the web site to be made up to 20 days after the date of completion. Any further corrections to the text can be made at a rate of £25 per hour.
Any other alterations are charged at £25 per hour.
Ownership
The site will remain the ownership of Konect Internet Ltd until the final payment is made. If the final payment is not made on time (within 7 working days of the invoice), the sites hosting will be suspended (this includes email services) until payment is complete.
Indemnification
Customer agrees that it shall defend, indemnify, save and hold Konect Internet Ltd (or it's employee's/owners) harmless from any and all demands, liabilities, losses, costs and claims, including reasonable legal fees asserted against Konect Internet Ltd, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, it's agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Konect Internet Ltd against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with Konect Internet Ltd server; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party and (3) copyright infringement. Customer agrees to limit the liability of Konect Internet Ltd to the amount paid for service.
Refunds Policy
Due to the nature of the work, we do not offer any kind of "money back" guarantee with this service.
Disclaimer
Konect Internet Ltd will not be responsible for any damages your business may suffer. Konect Internet Ltd makes no warranties of any kind, expressed or implied for services we provide. Konect Internet Ltd disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by Konect Internet Ltd and its employees. Konect Internet Ltd makes no "uptime" guarantees.
All communications (emails, verbal or written) are between Konect Internet Ltd and the client. These communications are private and are therefore not to be shared with any other parties.
Finally, Konect Internet Ltd wishes to emphasize that in accepting services, customers indemnify Konect Internet Ltd for the violation of any law or Konect Internet Ltd policy, that results in loss to Konect Internet Ltd or the bringing of any claim against Konect Internet Ltd. This means that if Konect Internet Ltd is sued because of activities of the customer that violate any law, or this policy, the customer will pay any damages awarded against Konect Internet Ltd, plus costs and reasonable legal fees.
Failure to comply with any of our terms and conditions will result in grounds for immediate account deactivation.
Konect Internet Ltd reserves the right to change, edit, or update the policies contained in this document at any time for any reason without notice.
